September 3, 2008 - 73 FR 51378-51381 - NUCLEAR REGULATORY COMMISSION - Criminal Penalties; Unauthorized Introduction of Weapons - The Nuclear Regulatory Commission (NRC) is proposing to amend its regulations to authorize the imposition of Federal criminal penalties on those who, without authorization, introduce weapons or explosives into specified classes of facilities and installations subject to the regulatory authority of the NRC. This action is necessary to implement section 229, ``Trespass on Commission Installations,'' of the Atomic Energy Act of 1954, as amended. DATES: Submit comments on the proposed rule October 20, 2008. Comments received after this date will be considered if it is practical to do so, but the NRC is able to assure consideration only for comments received on or before this date.
September 2, 2008 - 73 FR 51319-51322 - NUCLEAR REGULATORY COMMISSION - Nuclear Fuel Services, Inc., Environmental Assessment and Finding of No Significant Impact Related to Proposed License Amendment Authorizing the Processing of Uranium Hexafluoride in a New Process Line - The Nuclear Regulatory Commission (NRC) staff is considering the issuance of a license amendment to Materials License SNM-124, issued to Nuclear Fuel Services, Inc. (the licensee), to authorize the processing of uranium hexafluoride (UF6) in a new processing line (the CD Line). The NRC has prepared an Environmental Assessment (EA) in support of this proposed action. Based upon the EA, the NRC has concluded that a Finding of No Significant Impact (FONSI) is appropriate and, therefore, an Environmental Impact Statement (EIS) will not be prepared.

August 29, 2008 - 73 FR 51023-51024 - NUCLEAR REGULATORY COMMISSION - Dominion Energy Kewaunee, Inc.; Notice of Receipt and Availability of Application for Renewal of Kewaunee Power Station Facility Operating License No. DPR-43 for an Additional 20-Year Period - The U.S. Nuclear Regulatory Commission (NRC or Commission) has received an application, dated August 12, 2008, from Dominion Energy Kewaunee, Inc., filed pursuant to Section 104b of the Atomic Energy Act of 1954, as amended, and Title 10 of the Code of Federal Regulations Part 54 (10 CFR Part 54), to renew the operating license for the Kewaunee Power Station (KPS). Renewal of the license would authorize the applicant to operate the facility for an additional 20-year period beyond the period specified in the current operating license. The current operating license for KPS (DPR-43), expires on December 21, 2013. Kewaunee Power Station is a Pressurized-Water Reactor designed by Westinghouse that is located near Kewaunee, WI. August 29, 2008 - 73 FR 51016-51023 - NUCLEAR REGULATORY COMMISSION - In the Matter of Certain Licensees Authorized To Possess and Transfer Items Containing Radioactive Material Quantities of Concern; Order Imposing Additional Security Measures (Effective Immediately) - The Licensees identified in Attachment A \1\ to this Order, hold licenses issued by the U.S. Nuclear Regulatory Commission (NRC or Commission) or an Agreement State, in accordance with the Atomic Energy Act of 1954, as amended, and 10 CFR Parts 30, 32, 70 and 71, or equivalent Agreement State regulations. The licenses authorize them to possess and transfer items containing radioactive material quantities of concern. This Order is being issued to all such Licensees who may transport radioactive material quantities of concern under the NRC's authority to protect the common defense and security, which has not been relinquished to the Agreement States. August 28, 2008 - 73 FR 50856-50869 - DEPARTMENT OF VETERANS AFFAIRS - Determination of Presumption of Service Connection Concerning Illnesses Discussed in National Academy of Sciences Report on Gulf War and Health - As required by law, the Department of Veterans Affairs (VA) hereby gives notice that the Secretary of Veterans Affairs, under the authority granted by the Persian Gulf War Veterans Act of 1998, Public Law 105-277, title XVI, 112 Stat. 2681-742 through 2681-749 (codified in part at 38 U.S.C. 1118), has determined that there is no basis to establish a presumption of service connection at this time for any of the diseases, illnesses, or health effects discussed in the December 20, 2004, report of the National Academy of Science, titled ``Gulf War and Health, Volume 3. Fuels, Combustion Products, and Propellants'' based on exposure to fuels, combustion products, or propellants during service in the Persian Gulf during the Persian Gulf War. August 28, 2008 - 73 FR 50819-50820 - DEPARTMENT OF HEALTH AND HUMAN SERVICES - National Institute for Occupational Safety and Health; Designation of a Class of Employees for Addition to the Special Exposure Cohort - The Department of Health and Human Services (HHS) gives notice of a decision to designate a class of employees at the Spencer Chemical Company/Jayhawk Works near Pittsburg, Kansas, as an addition to the Special Exposure Cohort (SEC) under the Energy Employees Occupational Illness Compensation Program Act of 2000. On August 15, 2008, the Secretary of HHS designated the following class of employees as an addition to the SEC: All Atomic Weapons Employer (AWE) employees who worked at Spencer Chemical Company/Jayhawk Works near Pittsburg, Kansas, from January 1, 1956 through December 31, 1961 for a number of work days aggregating at least 250 work days occurring either solely under this employment or in combination with work days within the parameters established for one or more other classes of employees in the Special Exposure Cohort. This designation will become effective on September 14, 2008, unless Congress provides otherwise prior to the effective date. After this effective date, HHS will publish a notice in the Federal Register reporting the addition of this class to the SEC or the result of any provision by Congress regarding the decision by HHS to add the class to the SEC.

August 27, 2008 - 73 FR 50659-50660 - NUCLEAR REGULATORY COMMISSION - Office of New Reactors; Supplement to Interim Staff Guidance; Limited Work Authorizations Solicitation of Public Comment - The NRC is issuing a supplement to its Proposed Interim Staff Guidance (ISG) COL/ESP-ISG-004 for use and comment. This supplemental guidance would be added, along with the resolution of other issues identified in comments received from the public, to COL/ESP-ISG-004 to provide clarifications and examples related to the definition of construction. This additional guidance is intended to clarify the delineation of preconstruction activities and those activities that require prior NRC approval (i.e., construction activities). Upon receiving public comments, the NRC staff will evaluate and disposition the comments, as appropriate. (AIX) located in Anchorage, Alaska. AIX holds License No. 50-16084-01 issued by the Nuclear Regulatory Commission (NRC or Commission) pursuant to 10 CFR Part 34 to conduct radiography. The license authorizes AIX to possess sealed radioactive sources for use in conducting industrial radiography activities in accordance with the conditions specified therein. On June 4, 2007, an investigation was initiated by the NRC's Office of Investigations (OI), in part, to determine whether Mr. Kelly engaged in deliberate misconduct by performing radiography with only one radiographer present at the Arctic Slope Regional Corporation Energy Services (ASRC) facility, a temporary jobsite. A predecisional enforcement conference (PEC) was held on June 5, 2008, with employees of AIX, including Mr. Kelly, in an effort to obtain AIX's point of view on the violations. Based on our review of the information obtained during the PEC and from the investigation, two violations of the NRC's rule prohibiting deliberate misconduct, 10 CFR 30.10, were identified. First, Mr. Kelly engaged in deliberate misconduct in violation of 10 CFR 30.10(a)(1) by causing AIX to be in violation of 10 CFR 34.41(a) (also called the two-person rule) when he conducted radiography alone at the ASRC facility on numerous occasions since about 2004. Second, he provided information that he knew was incomplete and inaccurate during his sworn statement to NRC investigators, in violation of 10 CFR 30.10(a)(2), on July 24, 2007.
August 27, 2008 - 73 FR 50655-50657 - NUCLEAR REGULATORY COMMISSION - In the Matter of Mr. Kenneth J. August 27, 2008 - 73 FR 50651-50655 - NUCLEAR REGULATORY COMMISSION - In the Matter of Alaska Industrial X-Ray, Inc., Anchorage, AK; Order Modifying License (Effective Immediately) - Alaska Industrial X-Ray, Inc. (AIX or Licensee) is the holder of Materials License No. 50-16084-01 issued by the Nuclear Regulatory Commission (NRC or Commission) pursuant to 10 CFR Parts 30-36, 39, 40, and 70 and last amended on November 2, 2007, and due to expire on March 31, 2011. The license authorizes AIX to possess and use sealed radioactive sources in conducting industrial radiography activities in accordance with the conditions specified therein. In June 2007, the NRC conducted an onsite inspection and began an investigation into AIX activities to determine whether deliberate violations of NRC requirements occurred. During the investigation, the NRC discovered that AIX radiographers had conducted radiography activities in violation of 10 CFR 34.41(a) on multiple occasions at the Arctic Slope Regional Corporation Energy Services (ASRC) site and the Golovin site, both temporary jobsites. Of concern is that the NRC previously had issued an identical violation of 10 CFR 34.41(a) involving deliberate misconduct at the ASRC site on April 25, 2001 (EA-01-015). Based on the preliminary information from the investigation, the NRC issued an Order Suspending Licensed Activities (EA-07-261) on October 19, 2007, which, among other conditions, required that AIX suspend its radiography activities until adequate assurance could be provided by independent means that AIX would comply with NRC requirements when conducting licensed activities. On November 8, 2007, the NRC relaxed the Order based on several actions taken and commitments made by AIX to the NRC. The Order was a temporary measure while the NRC completed its investigation and reviewed the results. Once completed, the results of the inspection and investigation were discussed with AIX during a telephonic exit briefing on April 23, 2008, and were documented in NRC Inspection Report No. 030-10346/07-01 dated May 20, 2008.
August 27, 2008 - 73 FR 50649-50651 - NUCLEAR REGULATORY COMMISSION - Notice of Consideration of Issuance of Amendment to Facility Operating License, Proposed No Significant Hazards Consideration Determination, and Opportunity for a Hearing - The U.S. Nuclear Regulatory Commission (NRC or the Commission) is considering issuance of an amendment to Facility Operating License No. DPR-26, issued to Entergy Nuclear Operations, Inc. (Entergy or the licensee), for operation of the Indian Point Nuclear Generating Unit No. 2 (IP2) located in Westchester County, New York. The proposed amendment would change Technical Specification (TS) 3.8.1, Required Action A.4, to allow a one time extension to the completion time for the loss of one offsite power circuit from 72 hours to 144 hours to support replacement of one of the station auxiliary transformer (SAT) cooling oil pumps.
August 27, 2008 - 73 FR 50647-50649 - NUCLEAR REGULATORY COMMISSION - Dominion Nuclear North Anna, LLC; North Anna Esp Site, Early Site Permit ESP-003; Notice of Consideration of Approval of Transfer of Early Site Permit and Conforming Amendment and Opportunity for a Hearing - The U.S. Nuclear Regulatory Commission (the Commission) is considering the issuance of an order under 10 CFR 52.28, ``Transfer of Early Site Permit,'' 10 CFR 50.80, ``Transfer of Licenses,'' and 10 CFR 50.90, ``Application for Amendment of License, Construction Permit, or Early Site Permit,'' approving the direct transfer of the North Anna ESP Site Early Site Permit (ESP-003) currently held by Dominion Nuclear North Anna LLC (DNNA) as permit holder of ESP-003. The transfer would be to Virginia Electric and Power Company, doing business as Dominion Virginia Power (DVP), and Old Dominion Electric Cooperative (ODEC). The Commission is also considering amending the permit for administrative purposes to reflect the proposed transfer. According to an application for approval filed by DNNA, DVP, and ODEC, DVP and ODEC would become the holders of the Early Site Permit following approval of the proposed permit transfer and would assume all rights, duties, and obligations of ESP-003.

August 19, 2008 - 73 FR 48335-48350 - DEPARTMENT OF LABOR - Occupational Safety and Health Administration; Clarification of Remedy For Violation of Requirements To Provide Personal Protective Equipment and Train Employees - In this rulemaking, OSHA is proposing to amend its regulations to add language clarifying that noncompliance with the personal protective equipment (PPE) and training requirements in safety and health standards in these parts may expose the employer to liability on a per-employee basis. The amendments consist of new paragraphs added to the introductory sections of the listed parts and changes to the language of some existing respirator and training requirements. This action, which is in accord with OSHA's longstanding position, is proposed in response to recent decisions of the Occupational Safety and Health Review Commission indicating that differences in wording among the various PPE and training provisions in OSHA safety and health standards affect the Agency's ability to treat an employer's failure to provide PPE or training to each covered employee as a separate violation. The amendments add no new compliance obligations. Employers are not required to provide any new type of PPE or training, to provide PPE or training to any employee not already covered by the existing requirements, or to provide PPE or training in a different manner than that already required. The amendments simply clarify the remedy for violations of these requirements.

August 7, 2008 - 73 FR 46042-46054 - NUCLEAR REGULATORY COMMISSION - Environmental Assessment and Finding of No Significant Impact Related to the Issuance of a License Amendment for Construction of a Third Evaporation Pond, Homestake Mining Company of California Grants, New Mexico Project - Homestake Mining Corporation (HMC), through a variety of partnerships and joint venture associations, operated a uranium milling operation in Cibola County, New Mexico, beginning in 1958, and continuing through 1990. The site is north of the City of Grants in Section 26, Township 12 North, Range 10 West. Since 1990, the site has been in reclamation. Site reclamation includes facility decommissioning, tailings impoundment area restoration, groundwater restoration and monitoring, and post-closure care and monitoring. The site is licensed under NRC License SUA-1471. During operations, approximately 22 million tons of ore were milled at the site, using a conventional alkaline leach process (NRC, 1993). From 1993 to 1995, the mill was decommissioned and demolished. After the mill was demolished, final surface reclamation commenced in accordance with the amended U.S. Nuclear Regulatory Commission (NRC) requirements (NRC, 2006). Surface reclamation is nearly complete, with final reclamation and stabilization to be completed after groundwater restoration is completed. Groundwater contamination from past mill activities remains, and groundwater restoration is the primary activity occurring at the site. Once groundwater quality restoration is complete and approved, the site will be transferred to the U.S. Department of Energy (DOE), which will have the responsibility for long-term site care and maintenance.

Pursuant to its authority under section 5051 of Public Law 100-203, Nuclear Waste Policy Amendments Act of 1987, the U.S. Nuclear Waste Technical Review Board will meet in Las Vegas, Nevada, on Wednesday, September 24, 2008. At the meeting, the Board will review U.S. Department of Energy (DOE) activities related to designing and operating a waste management system in connection with the proposed repository for spent nuclear fuel and high level radioactive waste (HLW) at Yucca Mountain in Nevada. Among the issues that will be discussed are acceptance of spent nuclear fuel or HLW at commercial reactors or defense facilities; packaging of commercial spent nuclear fuel in transportation, aging, and disposal (TAD) canisters; transportation of the waste, including construction of a Nevada rail line; throughput of the waste at repository surface facilities; and plans for prototyping and testing of waste management equipment and facilities. This ISG is to clarify the U.S. Nuclear Regulatory Commission (NRC) position on what is an acceptable level of detail and content for demonstrating compliance with Title 10 of the Code of Federal Regulations Section 20.1406 (10 CFR 20.1406). Regulatory Guide (RG) 4.21, `Minimization of Contamination and Waste Generation: Life Cycle Planning,'' provides an acceptable method of demonstrating compliance. This ISG provides further clarification on the evaluation and acceptance criteria that will be used by NRC staff in reaching a reasonable assurance finding that a Design Certification (DC) or Combined License (COL) applicant has complied with the requirements of 10 CFR 20.1406. The proposed amendments would change the criteria for defining an ME for permanent implant brachytherapy from dose-based to activity-based; add a requirement to report, as an ME, any administration requiring a written directive (WD) if a WD was not prepared; clarify requirements for WDs for permanent implant brachytherapy; and make certain administrative and clarification changes. These amendments regarding permanent implant brachytherapy are being proposed in response to several incidents involving therapeutic use of byproduct material. The proposed changes are based in part on recommendations from NRC's Advisory Committee on the Medical Use of Isotopes (ACMUI) and the NRC's Medical Radiation Safety Team. This proposed rule would affect all medical licensees that perform procedures using byproduct material that require completion of a WD.

Since 2002, RES and EPRI, under a Memorandum of Understanding (MOU) on Cooperative Nuclear Safety Research, have been developing state-of-the-art methods for conduct of fire PRA. In September 2005, this work produced the ``EPRI/NRC-RES Fire PRA Methodology for Nuclear Power Facilities,'' NUREG/CR-6850 (EPRI 1011989). The course covers this state-of-the-art methodology.

The proposed amendment would revise the licensing basis to allow ganged rod drive capability of the Rod Control Management System (RCMS). NPF-37 and NPF-66 issued to Exelon Generation Company, LLC (the licensee) for operation of the Byron Station, Unit Nos. 1 and 2 (Byron), which is located in Ogle County, Illinois. The proposed amendment in the licensee's application dated June 17, 2008, would revise Technical Specification (TS) 5.5.9, Steam Generator (SG) Program, and TS 5.6.9, Steam Generator Tube Inspection Report. For TS 5.5.9, the amendment would incorporate a one-cycle interim alternate repair criteria (IARC) in the provisions for SG tube repair criteria during Byron, Unit No. 2, refueling outage 14 and the subsequent operating cycle. The IARC proposal requires full-length inspection of the SG tubes within the tubesheet but does not require plugging tubes if circumferential cracking observed in the region greater than 17 inches from the top of the tubesheet is less than a value sufficient to permit the remaining circumferential ligament to transmit the limiting axial loads. For TS 5.6.9, the amendment would revise the current reporting requirements. The proposed changes only affect Byron, Unit No. 2; however, they are docketed for both Byron units because the TS are common to both units.

This proposed rulemaking includes changes that clarify the license term limits for dry storage cask Certificates of Compliance (CoCs) and independent spent fuel storage installation (ISFSI) licenses, provide consistency between the general license requirements and the site-specific ISFSI license requirements, and allow part 72 general licensees to implement changes authorized by an amended CoC to a cask loaded under the initial CoC or an earlier amended CoC (a ``previously loaded cask''). More specifically, the proposed amendments would allow for longer initial and renewal terms for part 72 CoCs and licenses, clarify the general license storage term, clarify the difference between CoC ``approval'' and ``renewal,'' allow a licensee to apply the changes associated with a CoC amendment to a previously loaded cask without express NRC approval, provided the cask then fully conforms to the terms, conditions, and specifications of the amended CoC, and make certain administrative and clarification changes. The availability of the preliminary draft rule language is intended to inform stakeholders of the current status of the NRC's activities and solicit public comments on the information at this time.

August 1, 2008 - 73 FR 45029-45048 - DEPARTMENT OF HOMELAND SECURITY - Federal Emergency Management Agency; Planning Guidance for Protection and Recovery Following Radiological Dispersal Device (RDD) and Improvised Nuclear Device (IND) Incidents - The Department of Homeland Security (DHS) is issuing final guidance entitled, ``Planning Guidance for Protection and Recovery Following Radiological Dispersal Device (RDD) and Improvised Nuclear Device (IND) Incidents'' (the Guidance). This Guidance is intended for Federal agencies, State and local governments, emergency management officials, and the general public who should find it useful in developing plans for responding to an RDD or IND incident. The Guidance recommends ``protective action guides'' (PAGs) to support decisions about actions that should be taken to protect the public and emergency workers when responding to or recovering from an RDD or IND incident. The Guidance outlines a process to implement the recommendations, discusses existing operational guidelines that should be useful in the implementation of the PAGs and other response actions, and encourages federal, state and local emergency response officials to use these guidelines to develop specific operational plans and response protocols for protection of emergency workers responding to catastrophic incidents involving high levels of radiation and/or radioactive contamination.

July 31, 2008 - 73 FR 44780-44783 - NUCLEAR REGULATORY COMMISSION - Request for Comments on the Security and Continued Use of Cesium-137 Chloride Sources and Notice of Public Meeting - The NRC is conducting a public meeting to solicit early public input on major issues associated with the use of certain forms of cesium chloride (CsCl) currently used by NRC- and Agreement State-licensees. To aid in that process, the NRC is requesting comments on the issues discussed in this notice. While the NRC has not initiated rulemaking on this subject, we are utilizing the conventionally established rulemaking comment channels. Additionally, the NRC is requesting names of individuals to participate at the public meeting in a roundtable discussion of the issues discussed in Sections II and III of this notice.
July 31, 2008 - 73 FR 44779-44780 - NUCLEAR REGULATORY COMMISSION - Draft Regulatory Guide: Issuance, Availability - The U.S. Nuclear Regulatory Commission (NRC) has issued for public comment a draft regulatory guide in the agency's ``Regulatory Guide'' series. This series was developed to describe and make available to the public such information as methods that are acceptable to the NRC staff for implementing specific parts of the NRC's regulations, techniques that the staff uses in evaluating specific problems or postulated accidents, and data that the staff needs in its review of applications for permits and licenses. The draft regulatory guide (DG), titled, ``General Design Guide for Ventilation Systems of Plutonium Processing and Fuel Fabrication Plants,'' is temporarily identified by its task number, DG-3034, which should be mentioned in all related correspondence. Proposed Revision 1 of Regulatory Guide 3.12 describes a method that the staff of the NRC considers acceptable for use in complying with 10 CFR 70.23(a)(3) and (a)(4) with respect to the design of ventilation systems for plutonium processing and fuel fabrication plants. At plutonium processing and fuel fabrication plants, a principal risk to health and safety is the release and dispersal of radioactive materials. The prevention of such release and dispersal is an important function of the ventilation systems. To meet these objectives, this guide provides recommendations for achieving defense in depth and for minimizing the release of radioactive materials to the environment.

July 31, 2008 - 83 FR 44671-44673 - NUCLEAR REGULATORY COMMISSION - Eric Epstein; Denial of Petition for Rulemaking - The U.S. Nuclear Regulatory Commission (NRC) is denying a petition for rulemaking submitted by Eric Epstein (PRM-54-5). The petition requests that the NRC amend its regulations that govern renewal of operating licenses for nuclear power plants. Specifically, the petitioner requests that the NRC conduct a comprehensive review of U.S. nuclear power plant licensees' emergency planning during the license renewal proceedings. The NRC is denying the petition because the petition presents issues that the Commission carefully considered when it first adopted the license renewal rule and denied petitions for rulemaking submitted by Andrew J. Spano, County Executive, Westchester County, New York (PRM-54-02), and Mayor Joseph Scarpelli of Brick Township, New Jersey (PRM-54-03). The Commission's position is that the NRC's emergency planning system is part of a comprehensive regulatory process that is intended to provide continuing assurance that emergency planning for every nuclear plant is adequate. Thus, the Commission has already extensively considered and addressed the types of issues raised in the petition. Also, the petition fails to present any significant new information or arguments that would warrant the requested amendment.
July 31, 2008 - 73 FR 44619-44620 - NUCLEAR REGULATORY COMMISSION - Price-Anderson Act Financial Protection Regulations and Elimination of Antitrust Reviews; Correction - On October 27, 2005 (70 FR 61885), the Nuclear Regulatory Commission (NRC) published a final rule revising its regulations to conform with the provisions of the Energy Policy Act of 2005 that, among other things, terminated the NRC's authority and responsibility to conduct antitrust reviews of future applications to construct or operate a nuclear reactor. Inadvertently, the final rule failed to remove some references to the NRC's authority and responsibility to conduct antitrust reviews. This rule removes those provisions.
July 30, 2008 - 73 FR 44290-44291 - NUCLEAR REGULATORY COMMISSION - Florida Power And Light Co.; Establishment of Atomic Safety and Licensing Board - Pursuant to delegation by the Commission dated December 29, 1972, published in the Federal Register, 37 FR 28,710 (1972), and the Commission's regulations, see 10 CFR 2.104, 2.300, 2.303, 2.309, 2.311, 2.318, and 2.321, notice is hereby given that an Atomic Safety and Licensing Board is being established to preside over the following proceeding: Florida Power and Light Co., St. Lucie Nuclear Plant, Units 1 and 2 (Confirmatory Order, Effective Immediately). This Board is being established in response to a request for hearing that was filed pursuant to a notice issued by the NRC Staff (73 FR 36,131 (June 25, 2008)) that provided an opportunity for a hearing on the immediately effective confirmatory order of June 13, 2008 for the St. Lucie Nuclear Plant. The confirmatory order arose from investigations at St. Lucie Nuclear Plant by the NRC Staff that identified apparent violations for which escalated enforcement action was considered. The confirmatory order is the result of an agreement reached between the NRC Staff and the licensee, Florida Power and Light Co., during an alternative dispute resolution session. The NRC Staff determined that its concerns regarding public health and safety could be resolved through confirmation of the licensee's commitments as prescribed in the confirmatory order.
