January 31, 2012 - 77 FR 4807-4808 - DEPARTMENT OF ENERGY - National Nuclear Security Administration; Revised Fee Policy for Acceptance of Foreign Research Reactor Spent Nuclear Fuel From High-Income Economy Countries - This notice announces a change in the fee policy by the Department of Energy (DOE) for receipt and management of spent nuclear fuel (SNF) from foreign research reactors (FRR) containing uranium enriched in the U.S. in countries with high-income economies, as identified in the World Bank Development Report. The fee will increase in three phases (See Table 1) for all future SNF shipments (including Training, Research, Isotopes, General Atomics (TRIGA) from high-income economy countries. The first phase will take effect immediately and the fee will increase from no higher than $3,750 per kg total mass (not heavy metal mass) to $5,625 per kg total mass for SNF containing low enriched uranium (LEU). The second phase will be implemented automatically on January 1, 2014, and the fees will increase from $5,625 per kg total mass to $7,500 per kg total mass for shipments of SNF containing LEU and from no higher than $4,500 per kg total mass to $6,750 per kg total mass for SNF containing highly enriched uranium (HEU). The third phase will be implemented automatically on January 1, 2016, and the fee will increase from $6,750 per kg total mass to $9,000 per kg total mass for shipments of SNF containing HEU. DOE is also implementing a new minimum fee of $200,000 per shipment of any type and amount of eligible SNF to reflect a minimum cost of providing acceptance services. This minimum fee will take effect immediately. In the case where a reactor operator already has a signed and executed contract with DOE, DOE intends to negotiate an equitable adjustment to the fee in accordance with this revised fee policy. Under this revised fee policy, the fee for return of TRIGA fuel will be the same as that of aluminum based fuel. All other aspects of the fee policy are unaffected by this Notice.

January 25, 2012 - 77 FR 3640-3646 - NUCLEAR REGULATORY COMMISSION - Withdrawal of Proposed Rule and Closure of Petition for Rulemaking: Organization of Agreement States and Florida Department of Health, Bureau of Radiation Control - The U.S. Nuclear Regulatory Commission (NRC or the Commission) is closing a petition for rulemaking (PRM-31-5) submitted by the Organization of Agreement States, Inc. (OAS). The petition requested that the NRC amend its regulations to strengthen the regulation of radioactive materials by requiring a specific license for higher-activity devices that are currently available under a general license, and change the compatibility designation of applicable regulations from category B to category C. The petition also addresses a request filed by the Florida Department of Health, Bureau of Radiation Control, to change the compatibility category of a certain part of the applicable regulation from category B to category C. In response to the petition, the NRC developed a proposed rule that would have changed the compatibility of the applicable regulations, and would have limited the quantity of byproduct material contained in a generally-licensed device to below one-tenth of the International Atomic Energy Agency (IAEA) Category 3 thresholds. After further review, the NRC has decided to withdraw the proposed rule and to change the compatibility designation of the applicable regulations from category B to category C.
January 25, 2012 - 77 FR 3800-3804 - NUCLEAR REGULATORY COMMISSION - Accurate NDE & Inspection, LLC; Confirmatory Order - Accurate NDE & Inspection, LLC, (Accurate NDE or Licensee) is the holder of a general license issued by the U.S. Nuclear Regulatory Commission (NRC or Commission) pursuant to 10 CFR 150.20. This general license was granted to Accurate NDE at various times during calendar years between 2005 and 2011. This Confirmatory Order is the result of an agreement reached during an alternative dispute resolution (ADR) mediation session conducted on September 28, 2011, in Baton Rouge, Louisiana. On May 26, 2010, the NRC conducted a special inspection of licensed activities involving the use of byproduct material for industrial radiography conducted under a general license pursuant to the provisions of 10 CFR 150.20. The inspection was conducted in response to an event that occurred on March 15, 2010, involving the loss of a sealed source of iridium-192 while performing licensed activities in offshore Federal waters. On June 28, 2010, the NRC's Office of Investigations, Region IV, began an investigation (Case 4-2010-062) to determine if Accurate NDE, a State of Louisiana licensee, willfully failed to follow Louisiana license and NRC regulatory requirements. By letter dated July 28, 2011, the NRC transmitted the results of the inspection and investigation in NRC Inspection Report 150-00017/2010-002 and Investigation Report 4-2010-062 (ML11209B523) to Accurate NDE. Based on the results of the NRC inspection and investigation, the NRC determined that five apparent violations of NRC requirements had occurred. The apparent violations involved failures to: (1) Comply with the terms of an Agreement State license that requires the licensee to follow its operating procedures, which prohibit radiographers from attempting to retrieve a disconnected source without notifying the radiation safety officer (RSO); (2) maintain accurate information concerning personnel monitoring; (3) wear personnel dosimeters at all times while performing radiographic operations; (4) conduct a radiation survey when a radiographic exposure device is placed into storage; and (5) immediately report the loss of a sealed source of radiation. In addition, the NRC is concerned that willfulness may be associated with the apparent failure to follow the operating procedure that prohibits a radiographer from attempting to retrieve a disconnected radiography source without notifying the RSO, and the apparent failure to maintain accurate personnel monitoring information.
January 24, 2012 - 77 FR 3515 - NUCLEAR REGULATORY COMMISSION - Request for Action Against Omaha Public Power District and Nebraska Public Power District - Notice is hereby given that by petitions dated June 26 and July 3, 2011, respectively, Thomas Saporito (the petitioner) has requested that the U.S. Nuclear Regulatory Commission (NRC or the Commission) take escalated enforcement actions against Omaha Public Power District, the licensee for Fort Calhoun Station, Unit 1 (FCS), and Nebraska Public Power District, the licensee for Cooper Nuclear Station (Cooper). The petitions dated June 26 and July 3, 2011, are publicly available in the NRC's Agencywide Documents Access and Management System (ADAMS) under Accession Nos. ML11182B029 and ML11192A285, respectively. The petitioner has requested that the NRC take action to suspend or revoke the NRC licenses granted for the operation of nuclear power reactors and issue a notice of violation with a proposed civil penalty against the collectively named and each singularly named licensee in this matter--in the amount of $500,000 for Fort Calhoun Station and $1,000,000 for Cooper. Additionally, the petitioner requested that the NRC issue confirmatory orders to prohibit restart at FCS and to bring Cooper to a ``cold shutdown'' mode of operation until such time as: (1) The floodwaters subside to an appreciable lower level or sea level; (2) the licensee upgrades its flood protection plan; (3) the licensee repairs and enhances its current flood protection berms; and (4) the licensee upgrades its station blackout procedures to meet a challenging extended loss of offsite power due to floodwaters and other natural disasters or terrorist attacks.

This guide describes methods acceptable to the NRC staff for protecting safety-related structures, systems, and components against missiles resulting from turbine failure by the appropriate orientation and placement of the turbine-generator set, the management of the probability of turbine missile generation, and the use of missile barriers.
January 24, 2012 - 77 FR 3460-3461 - DEPARTMENT OF ENERGY - Reimbursement for Costs of Remedial Action at Active Uranium and Thorium Processing Sites - This Notice announces the Department of Energy's (DOE) acceptance of claims in FY 2012 from eligible active uranium and thorium processing site licensees for reimbursement under Title X of the Energy Policy Act of 1992. In FY 2009, Congress appropriated $70 million for Title X in the American Recovery and Reinvestment Act of 2009 (Recovery Act). Also in FY 2009, Congress provided $10 million for Title X through the normal appropriation process. As of the end of FY 2011, there are approximately $15.0 million of Recovery Act funds available for reimbursement in FY 2012. Of the $10 million provided by the FY 2009 appropriation, $9.9 million of unobligated balances was rescinded by the Department of Defense and Full Year Continuing Appropriations Act (Pub. L. 112-10); and the remaining $100,000 had been obligated for Title X audit support. No funds were appropriated for Title X in FY 2012. All of the remaining Recovery Act funds will be reimbursed to licensees in early calendar year 2012 following the review of claims received by June 3, 2011. Since the available Recovery Act funds are less than the total estimated amounts eligible for reimbursement (approximately $23 million), the reimbursements to licensees will be paid on a prorated basis.
January 24, 2012 - 77 FR - 3459-3460 - DEPARTMENT OF ENERGY - Cancellation of the Environmental Impact Statement for the Mountaineer Commercial Scale Carbon Capture and Storage Project, Mason County, WV - The U.S. Department of Energy's (DOE) Office of Fossil Energy is cancelling the environmental impact statement (EIS) under the National Environmental Policy Act of 1969 (NEPA) for the Mountaineer Commercial Scale Carbon Capture and Storage (CCS) Project in Mason County, WV (DOE/EIS-0445). DOE selected this project proposed by American Electric Power (AEP) under the Round 3 solicitation of the Clean Coal Power Initiative. DOE's proposed action was to provide $334 million in cost-shared financial assistance to AEP to support the construction and operation of AEP's proposed project.
January 23, 2012 - 3073-3075 - NUCLEAR REGULATORY COMMISSION - American Society of Mechanical Engineers (ASME) Codes and New and Revised ASME Code Cases; Corrections - The U.S. Nuclear Regulatory Commission (NRC) is correcting the preamble, or statements of consideration (SOC), and the codified text in a final rule that was published in the Federal Register on June 21, 2011 (76 FR 36232). The final rule amended the NRC's regulations to incorporate by reference various editions and addenda to the ASME Boiler and Pressure Vessel (B&PV) Code, and the ASME Code for Operation and Maintenance of Nuclear Power Plants (OM Code). The final rule also incorporated by reference (with conditions on their use) ASME B&PV Code Cases N-722-1 and N-770-1. This document is necessary to correct typographical, formatting, and punctuation errors.

As the basis for this request, the petitioner cites the NTTF Report as the rationale and basis of the petition.
January 23, 2012 - 3259-3261 - DEPARTMENT OF ENERGY - National Nuclear Security Administration; Notice of Intent To Prepare an Environmental Impact Statement for the Disposition of the Bannister Federal Complex, Kansas City, MO, and Notice of Wetlands Involvement - Pursuant to the National Environmental Policy Act of 1969 (NEPA), and the Council on Environmental Quality (CEQ) and U.S. Department of Energy (DOE) regulations implementing NEPA, the National Nuclear Security Administration (NNSA), a semi-autonomous agency within DOE, announces its intention to prepare an environmental impact statement (EIS) for the disposition of the Bannister Federal Complex (BFC) (BFC Disposition EIS; DOE/EIS-0475). The 300-acre BFC is owned by NNSA and the General Services Administration (GSA). NNSA owns the portion of the BFC known as the Kansas City Plant (KCP), consisting of approximately 122 acres and 38 buildings. GSA owns the remainder of the site, consisting of approximately 175 acres and 13 buildings. Beginning in 2013, NNSA will relocate its operations from the KCP to a newly constructed industrial campus eight miles south of the BFC. Once the move is completed, NNSA's real property at the BFC will be excess to the needs of its mission and will be available for disposition. GSA is currently analyzing its occupancy of the BFC and is performing a separate Environmental Assessment (EA) to evaluate a future relocation option. Because GSA could also decide to relocate its operations away from the BFC, it is a cooperating agency for the preparation of this EIS, which will analyze the potential environmental impacts for the disposition of GSA real property in addition to NNSA real property. The BFC Disposition EIS will analyze the potential environmental impacts associated with reasonably foreseeable potential future uses of the property, which could be different from its current uses. These potential future uses include industrial, warehousing, and commercial/office uses. NNSA also will assess the potential environmental impacts of partial and/or complete demolition of some BFC structures. Because the proposed project could involve actions in wetlands, the EIS will include a wetland assessment.
January 23, 2012 - 77 FR 3257-3259 - DEPARTMENT OF ENERGY - Transfer of Land Tracts Located at Los Alamos National Laboratory, New Mexico - The U.S. Department of Energy's National Nuclear Security Administration (DOE/NNSA) is issuing this Amended Record of Decision (ROD) for the Environmental Impact Statement for the Conveyance and Transfer of Certain Land Tracts Administered by the Department of Energy and Located at Los Alamos National Laboratory, Los Alamos and Santa Fe Counties, New Mexico, DOE/EIS-0293 (Conveyance and Transfer EIS) to address the remaining acreage of Los Alamos National Laboratory's (LANL's) Technical Area 21 (TA-21) Tract (about 245 acres) and the remaining acreage of the Airport Tract (about 55 acres). DOE/NNSA has determined that it is no longer necessary to retain these lands and will make them available for conveyance and transfer.

January 20, 2012 - 77 FR 2924-2926 - NUCLEAR REGULATORY COMMISSION - Notice of Public Meeting and Request for Comment on the Branch Technical Position on the Import of Non-U.S. Origin Radioactive Sources - The U.S. Nuclear Regulatory Commission (NRC) plans to conduct a public meeting on January 24, 2012, in Rockville, Maryland, to solicit input on a draft Branch Technical Position (BTP) on the Import of non-U.S. Origin Radioactive Sources. In 2010, the NRC published a final rule amending 10 CFR part 110 (75 FR 44072; July 28, 2010). Among other things, it added the phrase ``Of U.S. origin'' to the first exclusion to the definition of ``radioactive waste'' in Sec. 110.2. The phrase was added to the final rule in response to a public comment on the proposed rule to clarify the exclusion. Since publication of the final rule, industry has raised concerns with NRC staff regarding established industry practices and the need for guidance on implementation of the ``U.S. origin'' exclusion. The staff is holding a public meeting to obtain comments from stakeholders on the draft BTP and to discuss implementation issues associated with the ``U.S. origin'' exclusion.
January 20, 2012 - 77 FR 3010-3013 - NUCLEAR REGULATORY COMMISSION - In the Matter of Mr. Francis Guilbeau; Order Prohibiting Involvement in NRC-Licensed Activities - Mr. Francis Guilbeau was employed as a Radiographer at Accurate NDE & Inspection, LLC, (Accurate NDE or Licensee) located in Broussard, Louisiana, in March 2010. Accurate NDE is the holder of a general license issued by the U.S. Nuclear Regulatory Commission (NRC or the Commission) pursuant to Title 10 of the Code of Federal Regulations (10 CFR) 150.20. This general license was granted to Accurate NDE at various times during calendar years between 2005 through 2011. On May 26, 2010, the NRC conducted a special inspection of licensed activities involving the use of byproduct material for industrial radiography conducted under a general license pursuant to the provisions of 10 CFR 150.20. The inspection was conducted in response to an event that occurred on March 15, 2010, involving the loss of a sealed source of iridium-192 while performing licensed activities in offshore Federal waters. On June 28, 2010, the NRC's Office of Investigations, Region IV, began an investigation (Case No. 4-2010-062) to determine, in part, whether Mr. Guilbeau: (1) Willfully failed to follow operating procedures by attempting to retrieve a disconnected source without making the proper notifications and obtaining authorization from the Accurate NDE radiation safety officer (RSO); and (2) willfully recorded an inaccurate number for a pocket dosimeter reading on the Accurate NDE Daily Radiation Report dated March 14, 2010. By letter dated July 28, 2011 (ML11209B637), the NRC informed Mr. Guilbeau that the NRC was considering escalated enforcement action for two apparent violations of NRC's deliberate misconduct rule, 10 CFR 30.10. The NRC offered Mr. Guilbeau the opportunity to request a predecisional enforcement conference or request alternative dispute resolution (ADR) with the NRC in an attempt to resolve issues associated with this matter. In response, Mr. Guilbeau requested a predecisional enforcement conference. A predecisional enforcement conference was held with Mr. Guilbeau on August 25, 2011, in an effort to obtain Mr. Guilbeau's point of view on the violations.

DPR-67 and NPF-16, issued to Florida Power & Light Company (FPL, the licensee) for operation of St. Lucie Plant, Units 1 and 2 (St. Lucie 1 and 2), for a license amendment to increase the maximum thermal power from 2,700 megawatts thermal (MWt) to 3,020 MWt for each unit. In accordance with 10 CFR Section 51.21, the NRC has prepared this draft Environment Assessment (EA) and draft Finding of No Significant Impact (FONSI) for the proposed action. This represents a power increase of 11.85 percent over the current licensed thermal power. January 3, 2012 - 77 FR 135-137 - NUCLEAR REGULATORY COMMISSION - Exelon Generation Company, LLC, Oyster Creek Nuclear Generating Station; Exemption - In a letter to the Federal Emergency Management Agency (FEMA) dated August 29, 2011, (ADAMS Accession No. ML112800560), the New Jersey State OEM requested that FEMA postpone the exercise until 2012, citing the ongoing response to the Hurricane Irene aftermath. By letter dated August 31, 2011 (Attachment 3 to ADAMS Accession No. ML112730283), FEMA responded favorably to the New Jersey OEM request by agreeing to postpone the offsite portions of the biennial exercise until 2012. The onsite portion and some aspects of the offsite portions of the exercise were conducted on September 27, 2011. These portions were inspected by the NRC and evaluated by FEMA. The ASTSWMO believes the majority of unaccounted tritium exit signs are disposed of in solid waste landfills where they become potential sources of groundwater and surface water contamination. The ASTSWMO requested that the NRC revise its regulations or guidance to require that: the labeling be in several locations on the sign and printed with larger font; an expiration date should be distinctly legible to a fire or building inspector without taking down the sign; and the radiation trefoil should be displayed on the front and back of advertisements. Although not a specific request for rulemaking, the petitioner recommended that a national collection effort with distinct milestones and goals be undertaken to consolidate all expired and disused tritium exit signs. The petitioner requested that the NRC organize a meeting with ASTSWMO and all interested stakeholders to set a new path forward on this issue. The NRC is denying PRM-32-6 for the reasons stated in this document.
